The Zoning Board of Appeal today rejected a proposal for a cannabis shop at 1441 Tremont St., citing its proximity to the Tobin Community Center and another proposed marijuana mart on Terrace Street.
Jody Mendoza's Team Green had previously won approval from the Boston Cannabis Board for a 1,000-square-foot shop, but the zoning board cited its location within 500 feet of the entrance of the community center, and less than a half mile from former state Rep. Jeff Sanchez's previously approved store on Terrace Street.
The half-mile buffer zone continues to perplex board members, because the cannabis board keeps approving shops closer to each other than called for under the buffer set by the City Council.
"This whole issue of buffer zones continues to drive me nuts," board member Mark Erlich said.
Team Green argued that the buffer zone concept was intended to prevent "clustering" of cannabis concerns and that the stretch from Tremont to Terrace is not just a seven- to eight-minute walk, but passes various industrial and commercial lots that nobody would mistake for a "cluster." Also, Mission Hill, with roughly 24,000 people in one square mile, is far denser than most parts of Boston and so could easily support two shops.
Also at issue: Team Green's assertion the shop was not within the 500-foot state-mandated buffer from a school. However, the store would be 443 feet away from the Tobin Community Center, which is conected to the Tobin K-8 School and which has a large number of youth programs.

The banks are pretty upfront about the purpose of branches being not so much about making money by providing services to customers, but instead as tangible reminders that the bank exists: as giant billboards in effect. A branch in a high visibility location doesn’t need to be profitable operationally for the bank to consider the cost well spent. Pretty annoying that in the storefront real estate market they outcompete businesses that actually serve the neighborhood, such as convenience stores, hardware stores, restaurants etc

A community center and an elementary school do not need a cannabis store. Mission Hill does not need another cannabis store, nor does the Fenway.

Will you say the same thing when..
a) A new restaurant wants a liquor license
b) a new liquor store wants to open
c) A new dunkin donuts wants to open
d) A new starbucks wants to open
e) A new fast food place wants to open
f) a new 7-11 wants to open
g) a supermarket wants to open
f) a gym wants to open
All of these things sell vices. Yes food is a vice. So are lottery tickets. so is exercise.
So you mean to tell me that you'll be out in full force opposing these when they try to open too? Or are we still stuck in 1985 and "Just say No" and this is really about 'anti cannabis' not really the kids or community center.
I mean if we're gonna "just say no" .. we need to 'just say no to all vices', not just the ones we don't like.
See how that works? As a fat guy and a fat kid, the corner store near my house as a kid selling candy and soda has done more to worsen my health than pot ever did. Tbh I think that store did more damage to me as a kid, than the decade or so I did snorting cocaine.
Spare me the argument that this is about the kids and 'safety'. Please come back when you have more than a knee jerk reply about "no cannabis shops'.
